When state bestows citizenship on an individual it bestows upon them the most exclusive set of rights that are reserved only for nationals. In some states these rights are extended to all individuals born in the state others exclude this right from children born to migrants or only provide access to nationality if other conditions are met. Why and how states provide nationality to the children of migrants has largely been overlooked by a literature that either oversimplifies access for children or focuses on adults.
In this seminar, Shaina Western presents an evaluation of the laws of over 150 countries, using a new dataset, to determine where and how access to nationality is given to children. She argues that states treat children of migrants differently than they do their parents and that liberal democracies are more likely to liberalize access to nationality.
